Terms and Conditions for the Bluewater Application - Subscription
These terms and conditions ("Terms") govern your use of the subscription-based services provided by Bluewater through our mobile application (the “Bluewater App"). By subscribing to our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.
1. Subscription Services
Subscription Plans: We offer various subscription plans with different features and durations. By subscribing to a plan, you agree to pay the associated subscription fees.
Payment: You agree to pay all fees associated with your subscription in accordance with the pricing and payment terms provided at the time of subscription.
Automatic Renewal: Unless you cancel your subscription before the end of the current subscription period, your subscription will automatically renew, and you authorize us to charge the applicable subscription fees to your chosen payment method.
2. Account Registration
Account: In order to subscribe to our services, you must create an account on the App. You agree to provide accurate, current, and complete information during the registration process and to keep your account information updated.
Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.
3. Use of Services
License: Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to access and use the services provided through the App for your personal, non-commercial use.
Restrictions: You agree not to use the services for any unlawful or unauthorized purpose. You also agree not to modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works based on the App or its content.
4. Termination
Cancellation: You may cancel your subscription at any time by following the cancellation instructions provided in the App. Upon cancellation, your subscription will remain active until the end of the current billing cycle, and you will not be charged for any subsequent periods.
Termination: We reserve the right to terminate or suspend your subscription and/or access to the services at any time for any reason, including if we believe that you have violated these Terms.
5. Privacy
Privacy Policy: Your use of the services is subject to our Privacy Policy, which explains how we collect, use, and disclose your information. By using the services, you consent to the collection, use, and disclosure of your information as described in the Privacy Policy.
6. Limitation of Liability
Disclaimer: To the fullest extent permitted by applicable law, we disclaim all warranties, representations, and conditions, whether express or implied, regarding the services, including any warranties of merchantability, fitness for a particular purpose, or non-infringement.
Limitation of Liability: In no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, lost data, or business interruption, arising out of or in connection with your use of the services.
7. Changes to Terms
Modification: We reserve the right to modify or update these Terms at any time by posting the revised terms on our website or within the App. Your continued use of the services after any such changes shall constitute your acceptance of the revised Terms.
8. Governing Law
These Terms shall be governed by and construed in accordance with the laws of England, without regard to its conflict of law principles.

Terms & Conditions for the Bluewater Application – Daywork
1.These Terms and Conditions apply to Bluewater’s users when using the application “Daywork” and when posting and/or applying for “daywork” jobs on this website. By using the Bluewater Application - Daywork, users expressly agree and submit to these conditions.
2. Bluewater’s role is limited to enabling potential employers and potential candidates to post and apply for daywork jobs on Bluewater’s platform.
Bluewater is not providing a crew placement service through this application as the service is free of charge for its users.
3.Users are responsible for all postings and contents.
Users agree that they won’t:
Users warrant that they own or have all necessary rights to their postings. Users grant to Bluewater a non-exclusive, worldwide, royalty-free, sublicensable and transferable license to use, copy, modify, distribute and publish the postings (including for marketing and promotional purposes).
4.Bluewater may, in its sole discretion, modify or delete any or all of the postings, or temporarily or definitively suspend users’ ability to use the Bluewater Application – Daywork, without appeal. Bluewater will promptly inform the users when it chooses to exercise this discretion.
Bluewater may, in its sole discretion, reject or remove any posting at any time for any reason, regardless of whether or not such posting was previously accepted or served, or whether or not it breaches any of the provisions under Article 3 above.
5.In no circumstances shall Bluewater be liable (whether in contract or tort) for any loss of profits, failure to secure employment, loss of business, depletion of goodwill and/or similar losses, loss of contract, loss of or corruption of data or information, or any special, indirect, consequential or pure economic loss, costs, damages, charges or expenses suffered by users, for whatever reason.
6.Bluewater does not guarantee the accuracy of any candidate information, including but not limited to candidate applications, candidate identities, references, nor any posting information, including employer identity, salaries offered, and conditions of employment.
7.Users agree to indemnify Bluewater and hold Bluewater harmless from any damages, losses and costs (including but not limited to attorneys’ fees and legal costs) related to third party claims or proceedings, arising out or in relation to users’ postings, any candidate hiring or employment decisions, and breach of these Terms and Conditions.
9.Bluewater may use users’ personal information for the purpose of connecting potential employers with potential candidates.
Users’ data may be disclosed to third parties if this is necessary for the fulfilment of the above-mentioned purpose.
The Data collected will be stored for a period of time not exceeding the achievement of the abovementioned purpose.
In addition, users’ personal data may be archived for reason of legal certainty, particularly in the context of litigation for the establishment, exercise or defense of the legal rights of each of the parties.
Pursuant to relevant GDPR Regulations, users have the right to access, to rectification (updating), to erasure, to restriction of processing, data portability and to object; right to withdraw consent at any time without affecting the lawfulness of processing based on consent before its withdrawal; right to lodge a complaint with a supervisory authority relevant to the users’ residence.
If users wish to change or update the data Bluewater holds about them, or if users wish to exercise the above-mentioned rights, they can send an e-mail to Bluewater at support@bluewateryachting.com.
These Terms and Conditions shall be governed by English law and any dispute which has not been settled amicably shall be referred to the competent court in England.
Terms & Conditions for the Bluewater Application – Win
These Terms and Conditions apply to competitions organized by Bluewater featuring users of Bluewater's services.
By entering the competition, you hereby warrant that all information submitted by you is true, current and complete. We reserve the right to verify the eligibility of all participants.
A competition shall be open and closed for entries at the time and on the date specified in the application.
Any entries received before the opening or after the closing of the competition will be invalid and will not be entered into the competition.
No responsibility can be accepted for entries not received, for whatever reason.
We reserve the right to cancel or amend the competition and these Terms and Conditions without notice in the event of a catastrophe, war, civil or military disturbance, act of God or any actual or anticipated breach of any applicable law or regulation or any other event outside of our control. Any changes to the competition will be notified to entrants as soon as possible by us.
Entry into the competition will be deemed as acceptance of all of these Terms and Conditions.
Prize winners will be drawn at random. There shall be no right of appeal.
Competition prizes for each competition shall be specified on our application and always subject to availability and stock. We reserve the right to substitute any prize with another of equivalent value without notice. No cash alternative to the prizes will be offered. The prizes are not transferable.
Competition prize winners will be notified of the competition result by email.
We, as Controller of the processing of your personal data, are committed to protecting and respecting your personal information in accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (General Data Protection Regulation, “GDPR”).
We may use your personal information for the competition purposes.
